Welcome to KultrDrop. Throughout the site, the terms “we”, “us”, and “our” refer to KultrDrop. We operate this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

KultrDrop is powered by Shopify, which provides us with the online e-commerce platform that allows us to sell our products and services to you.

By visiting our site or purchasing something from us, you engage in our “Services” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein or available by hyperlink.

Section 1: Access and Account

• Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.
• Accuracy of Information: To use our Services, you may be asked to provide personal information (such as email, billing, and shipping details). You warrant that all information provided is current, accurate, and complete.
• Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Section 2: Products and Services

• Visual Accuracy: We strive to display product colors and images as accurately as possible. However, we cannot guarantee that your device’s display of any color will be a perfectly accurate representation of the physical product.
• Changes & Availability: All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.
• Purchase Limits: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis.

Section 3: Orders and Billing

• Right to Refuse: We reserve the right to refuse or cancel any order you place with us. This may include orders placed by the same customer account, the same credit card, or orders that use the same billing/shipping address.
• Payment: We must receive and successfully process your payment before an order is accepted. Once an order is processed, cancellations or modifications may not be possible due to the limited nature of our drops.
• Personal Use Only: You agree that your purchases are for personal or household use only and are not intended for unauthorized commercial resale.

Section 4: Shipping, Multi-Vendor Fulfillments & Made-to-Order Items

Because KultrDrop curates products from independent brands, items are shipped directly from our partner designers' studios:

• Split Deliveries: Orders containing items from multiple brand partners will be fulfilled separately and may arrive in multiple packages with distinct tracking numbers.
• Made-to-Order & Custom Garments: Items marked as Made-to-Order require a production lead time (typically 7–10 business days) prior to shipment.
• Carrier Risk & Delays: Once we or our brand partners transfer products to the shipping carrier, the risk of loss and title passes to you. KultrDrop is not liable for shipping delays caused by carriers, weather, or events outside of our reasonable control. All estimated delivery timelines begin after order processing/production is complete.

Section 5: Intellectual Property

All content included in the Services—such as text, graphics, logos, images, designs, and software—is the property of KultrDrop or its content suppliers and is protected by international copyright and trademark laws. You may use the Services for personal, non-commercial use only.

Section 6: Relationship with Shopify

KultrDrop is powered by Shopify. You acknowledge and agree that Shopify is not responsible for any aspect of the transactions or sales between you and KultrDrop. You hereby release Shopify from all claims and liabilities arising from your transactions with us.

Section 7: Prohibited Uses

In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site or its content:

• For any unlawful purpose or to solicit others to perform unlawful acts.
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• To harass, abuse, insult, harm, defame, or discriminate against employees, brand partners, or other users.
• To upload or transmit viruses, malicious code, or any malware that compromises site security.
• To collect, scrape, or track the personal information of others.

Section 8: Disclaimer of Warranties; Limitation of Liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, KultrDrop shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits, lost revenue, or lost savings—arising from your use of the service or any products procured using the service.

Section 9: Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to conflict of law principles.
